Very interesting that you show five justices; for, upon quoting Chief Justice Charles Evans Hughes (“The Constitution is what the judges say it is”), historical essayist Alistair Cooke noted that “Indeed, since a majority of the nine decides everything, the Constitution is what five judges say it is.” So, apparently the court engages in time travel and mind-sharing beyond the grave to ensure that they tell us what the Founding Fathers and Constitutional creators “meant” when they wrote up the document in 1787. Why did the word “oligarchy” just pop into my head?
